These Terms of Service govern your use of urbancalmcoffee.ca and any purchases or services provided by Urban Calm Coffee.
By visiting our website, creating an account, placing an order, purchasing a subscription, participating in our rewards program or otherwise using our services, you agree to these Terms of Service.
If you do not agree with these terms, please do not use our website or services.
1. Online Store Terms
You must be legally capable of entering into a binding agreement in your province or territory of residence to make purchases through our website.
You may not use our products, website or services for any unlawful or unauthorized purpose.
You must not transmit viruses, malicious code or other technology intended to interfere with the operation, security or functionality of our website or services.
We reserve the right to refuse service where reasonably necessary to protect Urban Calm Coffee, our customers, our service providers or the integrity of our website.
2. Products and Product Information
We make reasonable efforts to display product descriptions, photographs, ingredients, sizes, packaging and other information as accurately as possible.
Product appearance, packaging, labels or colours may occasionally differ from photographs shown online due to packaging updates, production changes, screen settings or other factors.
We may modify, discontinue or limit the availability of a product at any time.
All products are subject to availability.
3. Coffee, Functional Mushrooms and Wellness Information
Information provided on our website, Learning Centre, product pages, packaging, emails or other communications is provided for general educational and informational purposes.
Statements concerning coffee, functional mushrooms, ingredients, nutrition or wellness are not intended to diagnose, treat, cure or prevent any disease and are not a substitute for professional medical advice.
Individual experiences may vary.
If you have questions about whether a product is appropriate for you, particularly if you are pregnant, nursing, taking medication or have a medical condition, consider consulting an appropriate healthcare professional.
4. Pricing and Payment
Unless otherwise stated, prices on urbancalmcoffee.ca are displayed in Canadian dollars.
Applicable taxes and shipping charges are calculated during checkout.
We reserve the right to change product prices, promotions and offers at any time. Changes will not affect orders that have already been accepted unless required to correct an obvious pricing or technical error.
Payment must be successfully authorized before an order can be processed.
Payments are handled through Shopify and supported payment providers.
5. Errors, Inaccuracies and Omissions
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping or other information.
We reserve the right to correct errors or inaccuracies and to update information at any time.
If an obvious pricing or technical error affects an order, we may contact you to correct the order or cancel it and issue a refund.
6. Orders and Order Acceptance
Submitting an order does not necessarily mean that the order has been accepted.
We reserve the right to refuse, limit or cancel an order where reasonably necessary, including in cases involving suspected fraud, payment issues, inventory errors, pricing errors, suspected resale activity, abuse of promotions or other unusual circumstances.
If we cancel an order after payment has been collected, the applicable amount will be refunded.
We may limit quantities purchased per person, household, customer account or order.
7. Shipping and Delivery
Urban Calm Coffee currently ships within Canada.
Shipping charges, free-shipping thresholds, processing times and estimated delivery times are described in our Shipping Policy.
Delivery dates are estimates and may be affected by carrier delays, weather, holidays, remote destinations and circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address.
8. Returns, Refunds and Satisfaction Guarantee
Returns, refunds, damaged or incorrect orders and our first-order satisfaction guarantee are governed by our Refund Policy.
Our Refund Policy forms part of these Terms of Service.
Nothing in these terms limits rights or remedies that cannot legally be excluded under applicable consumer protection legislation.
9. Subscriptions
Certain products may be offered on a recurring subscription basis.
When you purchase a subscription, you authorize recurring charges using the payment method associated with your subscription according to the delivery frequency you select.
Eligible subscriptions currently receive the subscription discount displayed when the subscription is purchased.
You may manage, modify or cancel an eligible subscription in accordance with our Subscription or Cancellation Policy and the functionality provided through our subscription platform.
Changes or cancellations must be completed before an upcoming order has been processed to apply to that order.
Subscription pricing, discounts and available frequencies may change for future orders where permitted by law. Where appropriate, notice will be provided before a material change takes effect.
10. Promotions and Discount Codes
From time to time, Urban Calm Coffee may offer promotional pricing, discount codes, gifts with purchase or other offers.
Promotions may have eligibility requirements, minimum purchase amounts, start and end dates, product exclusions or other conditions.
Unless explicitly stated otherwise, promotional offers cannot be combined.
Discounts have no cash value and may not be sold, transferred or redeemed for cash.
We may cancel or restrict the use of a promotion where we reasonably believe it is being misused, duplicated, manipulated or used contrary to its stated terms.
11. Rewards Program
Urban Calm Coffee may provide customers with access to a rewards or loyalty program.
Points, rewards, discounts or benefits provided through the program have no cash value unless expressly stated otherwise.
We may modify rewards, redemption levels, earning rules or program features from time to time.
We reserve the right to remove points or restrict participation where there is evidence of fraud, abuse or manipulation of the rewards program.
12. Gift Cards and Store Credit
Gift cards and store credits may be used according to the terms displayed when they are issued.
Gift cards and store credit are not redeemable for cash except where required by law.
Lost or stolen gift cards may not be replaceable if ownership or the remaining balance cannot reasonably be verified.
13. Reviews and Customer Content
If you submit a product review, photograph, comment, testimonial or other content to Urban Calm Coffee, you confirm that the content is yours or that you have permission to provide it.
You grant Urban Calm Coffee a non-exclusive, royalty-free licence to use, reproduce, publish, display and share that content in connection with our website, marketing, advertising and business activities, subject to applicable privacy and advertising laws.
We may moderate or remove content that is unlawful, misleading, abusive, fraudulent, offensive, unrelated to the product or otherwise inappropriate.
We will not knowingly alter a genuine customer review in a way that materially changes the customer's expressed opinion.
14. Intellectual Property
The content of urbancalmcoffee.ca, including our branding, logos, product names, photographs, graphics, text, designs, videos and other materials, is owned by or licensed to Urban Calm Coffee unless otherwise indicated.
You may use the website for your personal, non-commercial use.

Our store is hosted by Shopify and may use third-party services for payments, shipping, subscriptions, reviews, rewards, marketing, analytics and other functions.
Your use of certain third-party services may also be subject to that provider's terms and privacy policies.
We are not responsible for the acts, omissions or independent policies of third parties that we do not control.

18. Disclaimer of Warranties
We make reasonable efforts to provide a secure, accurate and reliable website and customer experience.
However, to the maximum extent permitted by applicable law, the website and its content are provided on an "as available" basis.

Nothing in this section excludes warranties or consumer rights that cannot legally be excluded.
